A Coral Springs man previously arrested for allegedly assaulting his ex-girlfriend and dumping feces-filled backpack contents on her is now charged with vehicular homicide in a fatal Margate crash that killed one person and injured another.
According to Margate Police Department records, Daniel Edward Niemiec, 20, was charged with one count of vehicular homicide, one count of reckless driving causing injury, and three counts of reckless driving causing property damage in connection with a February 2 crash in Margate.
According to Margate Police, officers responded around 7:48 p.m. to a two-vehicle crash in the 4900 block of West Atlantic Boulevard.
Investigators said Niemiec was driving a 2025 white Lexus eastbound on Atlantic Boulevard when he struck the passenger side of a Kia that was making a left turn. The impact caused multiple secondary collisions before the Lexus left the roadway and slammed into an electrical pole.
The front-seat passenger in the Kia became trapped inside the vehicle and had to be extricated by Margate Fire Rescue. Police said the passenger later died from injuries sustained in the crash on February 4. The Kia’s driver suffered injuries to her stomach and legs.
According to the affidavit, multiple witnesses described the Lexus traveling at a high rate of speed while weaving in and out of traffic before the collision. Investigators also reviewed surveillance and dash camera footage, which they said showed the Lexus passing other vehicles and weaving through traffic.
Police said data recovered from the Lexus’ event data recorder showed the vehicle was traveling 90 mph with the accelerator pressed 22 percent just before impact in a 45 mph zone. Investigators also conducted a speed analysis using surveillance video that estimated the Lexus was traveling approximately 86.8 mph before the crash.
Based on the evidence, investigators concluded Niemiec was operating the vehicle in a reckless manner by speeding excessively and weaving through traffic, showing “a willful disregard for the safety of others” that was likely to cause death or serious bodily harm, according to the affidavit.
The charges come just weeks after Coral Springs Talk was the first to report Niemiec was arrested by Coral Springs Police on allegations that he attacked his former girlfriend during a domestic dispute.
According to Coral Springs Police, the victim told investigators Niemiec slapped and choked her during an argument. Days later, when she returned to retrieve her belongings from his apartment complex, police said Niemiec brought out her backpack after allegedly filling it with feces, urine, hot sauce, ketchup, soda and other liquids before dumping the contents on her in the parking lot.
Investigators said Niemiec later admitted throwing the backpack’s contents, telling detectives he believed the victim had cheated on him and that the act “would be payback.”
Court records show Niemiec is being held without bond on the vehicular homicide charge.
