A Margate man was charged with a hate crime for allegedly threatening a Black man with a gun while using a racial slur, all while standing naked outside his front door, according to court records.
After the victim parked his car near the 800 block of Southwest 54th Avenue on July 24, he saw Brian Nobert, 62, nude and holding a gun on his property around 8 p.m., the Margate Police records allege.
An arrest affidavit states that Nobert allegedly yelled at the victim and told him, “Get off my property, n – – – – -,” a witness told police.
The victim was standing in the road, not on Nobert’s property, police said.
He told investigators he heard a “click clack” noise from the gun. Believing Nobert was about to open fire, he fled to a nearby home and called police, according to the records.
Later, when police arrived to arrest Nobert, he talked about having suicidal thoughts and “kept advising that police will have to come in [to his home] and take him and there will be a gun battle,” the records state.
Nobert, who is white, was charged with two felonies: aggravated assault with a deadly weapon without intent to kill and evidencing prejudice while committing an offense.
The latter charge is a hate crime—the result of Nobert allegedly using the racial slur against the victim, records show.
According to court records, Nobert was jailed before his release Tuesday on a $10,000 bond. The records did not indicate whether he entered a plea or hired an attorney.
