A Margate man was charged with felony battery by strangulation after an argument with his wife over their sex life turned violent.

Cesar Rodriguez, 41, Margate, was arrested on February 1 after the Broward County Sheriff’s Office responded to an emergency domestic violence incident at the 5500 block of North Lakewood Drive, indicating a victim had been physically harmed.

Upon arrival, deputies encountered Rodriguez and his wife, the victim, who told deputies the couple had been involved in a verbal argument over their sex life, according to the police report.

The victim told deputies after a heated argument over the couple’s sex life, Rodriguez became angry and choked her until she was unable to breathe properly and was losing consciousness.

The arrest report states in an interview with deputies Rodriguez claimed the argument with his wife was only verbal and never turned physical, but admitted to having choked his wife during intercourse approximately two weeks ago.

Contrary to Rodriguez’s claims, his wife’s neck showed signs of recent trauma in the form of slight redness on the left side, according to deputies in the police report. Photographs of the victim’s neck were taken on the scene and entered as evidence in the case.

A witness in the residence told deputies they did not see Rodriguez choking his wife but did hear her screaming for the defendant to stop choking her, according to the arrest report.

Rodriguez was arrested for felony battery by strangulation and was transported to the Broward County Main Jail. He was later released and placed on house arrest pending a hearing.
