“Just Take Me to Jail”: Routine Traffic Stop Leads to Arrest of Man with Loaded AR-15

A routine stop by a Margate police officer led to the arrest of a man driving with fraudulent tags and possessing a loaded AR-15 he claimed did not belong to him.

On January 23, Davian Oates, 30, Oakland Park, was arrested and charged with second-degree felony possession of a short-barreled firearm and five additional charges of operating an unregistered vehicle with fraudulent registration. 

According to the police report, a Margate officer conducting a routine patrol in the 400 block of North State Road 7 observed Oates driving a silver BMW sedan bearing a temporary tag. 

After conducting a preliminary records check, the database revealed the vehicle’s plate resulted in a “no records found” prompt, which the officer later wrote in the report most often indicates the sign of fraudulent registration. As a result, Oates was pulled over by the officer.

Upon questioning, the report states Oates repeatedly claimed he was not the vehicle owner, claiming a friend had purchased it through an auction in New York. Oates did, however, admit to driving the car often enough that he was responsible for acquiring a tag.

According to the police report, Oates said he acquired the fraudulent license plate on the vehicle from a friend in Miami and was subsequently arrested. 

As officers arrested Oates, a search of the vehicle resulted in the discovery of a firearm in the trunk described in the report as a Bushmaster AR-15 style short-barreled gun. Further examination found the firearm loaded with 16 rounds of .223 bullets, according to the report.

Oates admitted knowledge of the firearm but claimed it belonged to another friend, whom he also refused to name. 

According to the report, Oates refused the opportunity by officers to call the firearm’s owner and responded, “just take me to jail.”

Davian Oates would get his wish as officers arrested him and escorted him to Broward County Main Jail, where he remains with no bond.
